Terms and Conditions for the "Holy Energy Black Week 2024" Giveaway

Hereinafter referred to as the "Organiser."
This giveaway is in no way associated with, sponsored by, or organized by Instagram, Facebook, or TikTok.
All questions, comments, or complaints about this giveaway should be directed to the Organiser at uk.weareholy.com.
By participating in this giveaway, participants confirm that they have read, understood, and accepted the following terms and conditions.

1. Duration of the Giveaway
1.1 The giveaway is open for entries from 24 November 2024, 10:00 am until 16 December 2024, 15:00 pm ("Entry Period").
1.2 Any entries submitted after the Entry Period will be excluded.
1.3 The Organizer reserves the right to end or modify the giveaway at any time without providing a reason. Participants will be informed of any changes.
1.4 The Organizer also reserves the right to end or modify the giveaway without notice if technical or other reasons prevent its proper execution or compromise its fairness.

2. Eligibility
2.1 The giveaway is open exclusively to individuals aged 18 or older who are permanent residents of the United Kingdom.
2.2 Employees of the Organiser, their relatives, and anyone directly or indirectly involved in organising the giveaway are excluded from participation.
2.3 Any attempt to manipulate the giveaway will result in immediate disqualification.

3. How to Participate
3.1 To participate, individuals must make a purchase of at least £10 through the Organiser's online shop during the Entry Period.
3.2 For every £10 spent, participants will receive one entry into the giveaway. For example, a purchase of £70 provides seven chances to win.
3.3 Participants must provide their full name, email address, and delivery address to enter.
3.4 Orders that are canceled or refunded within the statutory 14-day cooling-off period will be excluded from the giveaway. The Organiser reserves the right to verify eligibility after the fact.

4. Prize
4.1 The prizes are 3x PlayStation 5 Consoles with an exclusive HOLY Energy skin.
4.2 No additional costs or services are included in the prize.
4.3 The prize cannot be negotiated, exchanged, or transferred. No cash alternative or substitution for another product is permitted.

5. Selection and announcement of the winners
5.1 The winners will be randomly selected during the participation period and notified via email and announced on @holysquad.uk on 16.12.24. The participant is responsible for ensuring that the organiser's messages can be received.
5.2 The winner has 2 weeks from the time the notification is sent to accept the prize by email to curtis@weareholy.com. If the winner does not respond within 2 weeks, the right to the prize expires and a new winner will be determined and notified.
5.3 The organiser is entitled to exclude participants from the competition without prior notice if they do not comply with the conditions underlying the competition or if they manipulate the competition, in particular the participation procedure, and/or if they intentionally violate the terms of use.
5.4 The organiser may exclude participants who revoke the order entitling them to participate.

6. Limitation of Liability
6.1 The Organiser is not liable for any damages resulting from participation in the giveaway or the use of the prize, except in cases of willful misconduct or gross negligence.
6.2 The Organiser assumes no responsibility for defects or damages to the prize after delivery.
6.3 In all other cases, the Organiser's liability is limited to foreseeable damages typical for such giveaways.
6.4 This limitation of liability does not apply to damages caused by injury to life, body, or health.

7. Data Protection
7.1 The Organizer processes personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and applicable data protection laws.
7.2 The following personal data will be processed for the purpose of the giveaway:
Full name
Email address
Delivery address
7.3 Personal data will be used exclusively for the execution and administration of the giveaway and will not be shared with third parties.
7.4 Participants can withdraw their consent to data processing at any time by contacting the Organiser at uk.weareholy.com. In such cases, the right to the prize will be forfeited.

8. Miscellaneous
8.1 This giveaway is governed exclusively by the laws of England and Wales.
8.2 The decision of the Organiser is final, and no correspondence will be entered into.
8.3 If any provision of these terms and conditions is found to be invalid, the validity of the remaining provisions shall not be affected.

The competition runs until December 2 at 3 pm. Until then, your order from HOLY automatically enters you into the competition.

We will ship the console from our office in Berlin. We will cover all Shipping and Customs charges.
